This Privacy Policy (“Policy”) describes the information collected by or on behalf of Enerfina LLC, a Delaware limited liability company (“Enerfina” “we,” “us,” or “our”), through our mobile application RWW Manor Collection (“App”) available through your mobile phone provider’s app store or our website www.enerfinallc.com (“Site”, and the App and Site, collectively, our “Services”) and how the information is used, protected and shared. This Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. Capitalized terms not defined in this Privacy Policy will have the meaning set forth in our Terms of Use. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions. If you have questions or concerns about this Policy, please contact us as set forth below.  
 
We may modify this Policy at any time. All changes will be effective immediately upon posting to the Services. Material changes will be conspicuously posted on the Services or otherwise communicated to you.

Information We Collect 
 
We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Information”) about you when you use our Services. The Personal Information we collect falls into three categories: (a) information you provide to us; (b) information we collect through automated methods when you use our Services; and (c) information we collect from other sources (each as further detailed below). We will collect, use, and share such Personal Information pursuant to this Policy and applicable law. 
 
You can access our Services without submitting Personal Information. However Personal Information is required to use certain features of the Services, for example, to make an account, to make a purchase, and to contact us or otherwise respond to communications from us. In such circumstances, we may be unable to provide you with our Services unless you provide your Personal Information.  
 
 Information You Provide to Us 
 
We collect Personal Information that you provide directly to us in the following ways:  
 
Account Creation. While you will be able to browse our products and use the Services as a “guest” without creating an account, you will be required to create an account to make any purchases through the Services. When you create an account through the Services, you will be prompted to insert your name, email address, mailing address, and telephone number. You will also be required to create a user ID and password. You may have the ability to sign up by linking your Apple or Google account instead. This data will be used to populate a profile within your account.  
 
Order & Payment Data. When you make a purchase through our Services, we use a PCI-compliant payment processor to help us facilitate payment. If you make a purchase of products through the Services, you may make payment by credit card or debit card through our payment processor, Square, or by using Apple Pay, Google Pay, or PayPal. To make a purchase via the Services, you will need to provide your name and your credit or debit card type, number, expiration date, security code, and billing address either through our payment portal or login to your Apple, Google, or PayPal account. Payment by credit or debit card is subject to the approval of the card issuer. Enerfina does not receive your credit card, debit card or other financial information when you make a payment- such information is provided directly to the applicable payment processor. We will not be liable in any way if a card issuer refuses to accept a credit or debit card for any reason. However, Enerfina does receive information about your purchase (e.g., order details) and your contact information (e.g., name, email address, mailing address, phone number). Enerfina will keep a record of your purchases.  
 
Requests for Quotes and Information. To request a quote for a Enerfina product or to request information via the Services you will need to provide your contact information (as discussed above) and, as applicable, details of the product(s) or information in which you are interested. 
 
Delivery Scheduling. When you schedule a delivery, you will be required to submit your name, email, and phone number. 
 
Information About Your Use of Our Online Tools. If you choose to use our online tools, we will collect all information that you provide in the course of using those tools. Our online tools may include, for example, our configurators and system specifiers. You will need to enter certain information to use those tools, which may include the names and specifications of fixtures and other products and building and project data. 
 
Location-Based Data. With your consent, we may collect geolocation of your device by using GPS, Wi-Fi signals, or other technologies. We will collect this data if you opt-in through the App or Site to improve special offers and to enable location-driven features and functionalities on your device. We may, with your consent, access your location information to enhance your user experience and increase the usefulness of our Services. This includes both geographical location information that you input using the Services (e.g., when you enter your zip code, city, or physical address) and as applicable, geographical location information collected by device-based location services (including GPS data). You may choose to allow us to access your location by granting the Services access to your location when prompted or through your device’s location services settings. You may revoke your consent to share your location data at any time through the App or Site, as applicable. You may decline to allow us to collect such geolocation information, in which case we will not be able to provide certain features or functionalities to you. 
 
Communications. If you sign up receive communications from us, you may be required to provide your name, email address, and phone number. We use this data to send you the communications requested, including communications relating to our services and your transactions with us. We may also use this information to end you certain promotional and marketing communications. You may opt-out of such marketing emails by using the “Unsubscribe” link in the email, replying “STOP” to text messages, or contacting us at [email protected] with “Unsubscribe” in the subject line with details of your request. Opting out of marketing communications will not opt you out of non-marketing communications, such as emails or text messages about your account or transactions. We may use third-parties or service providers to deliver communications to you.  
 
Chat Conversations. If you use a chat feature within our Services, we will collect all text and other data that you submit via that chat feature. If you use a chat feature while signed into your account, we may link the chat information to your account.  
 
Feedback. When you provide comments or feedback about our Services (“Feedback“), we will not treat that Feedback as confidential, and we may use that Feedback for any purpose in our sole discretion so long as it does not personally identify you. Feedback will be used without attribution or compensation to you. 
 
Data Automatically Collected 
 
We may use automated technologies (“Automated Technologies”) to collect information from your mobile device when you use our Services. This may include the following: 
 
App Analytics. Our App uses third-party mobile application analytics tools, including Firebase (a Google product) to collect data about your use of our App, which data your device automatically sends to and is stored by those analytics providers. This data includes performance metrics, page views, usage data, and request and response times. Our mobile application analytics providers us this data to provide us with reports about use of our App.  
 
Google Analytics. We may also use Google Analytics to collect and process information about your use of the Site. Google sets cookies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with our Site.

Google Maps. We may use the Google Maps API(s). Pursuant to the Google Maps APIs Terms of Service, use of this location feature is also subject to Google’s privacy policy (linked above). Both the Google Terms of Service and Google’s Privacy Policy are incorporated into this Privacy Policy by this reference. 
 
Data from Other Sources.  
 
We obtain data about you from various third-party companies, third party sales companies, contractors, manufacturers and other vendors, persons, or entities that you and/or Enerfina may be utilizing to access our Services. We may combine that data with other Personal Information. This enhances our existing data about our users, improves our ability to contact you, and enhances our marketing capabilities. 
 
How We Use Your Information.  
 
In addition to the uses described above, we use Personal Information that we collect for the following purposes: 
 
As Stated or Agreed to at the Point of Collection. We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we use Personal Information to respond to your questions, comments, or complaints. We may also use Personal Information as requested or consented to by you and to ensure appointments are kept and products ordered are available. 
 
Administration. We use Personal Information for administrative purposes, such as scheduling and facilitating appointments, to inform our business strategies, and to understand our Services’ demographics and user preferences. 
 
Services Management. We use Personal Information for management of our Services, such as troubleshooting problems, improving the content and functionality of our Services, statistical and other analyses of our Services, and to customize our Services to you and our users. 
 
Business Analytics. We use Personal Information for business analytics purposes, including consumer and operations research, to assess the effectiveness of our Services, marketing, and advertising, and to analyze market trends and customer demand. 
 
Advertising and Communications. We may use Personal Information to send you promotions, to notify you of new services, products, or programs, to notify you of new features of our Services, to notify you of changes to our Terms or this Policy, and for other similar communications. How We Use Data Tracking Technologies.

We may use cookies, web beacons, pixel tags and other tracking technologies (collectively “Tracking Technologies“) on our Services. A cookie is a small text file that our Services saves onto your computer or device when you use our Services that provides us certain information about your activities. Cookies allow our Services to remember your actions and preferences and recognize you or your browser, along with some information you provided. Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage. 
 
We use Tracking Technologies to: (i) make our Services function properly; (ii) provide personalized experiences; (iii) tailor our interactions with you; (iv) help with our marketing efforts; (v) provide us with valuable data and statistics about the usage and effectiveness of our Services and to help us improve our Services; and (vi) help us improve our Services.  
 
Most browsers automatically accept Tracking Technologies. You can disable this function by changing your browser settings, but disabling certain Tracking Technologies may impact your use and enjoyment of the Site. Not all features or functions of our Services may work properly if you disable Tracking Technologies. You cannot disable all cookies, such as cookies that are essential to the functioning of the Site. 
 
Disclosure of Personal Information 
 
We do not sell, rent, or lease Personal Information to any third party. We may share Personal Information with the following categories of parties, in compliance with applicable laws:

These third parties and service providers include our suppliers, consultants, agents, distributors, sales representatives, resellers, and others (including for Services management, marketing providers) or other service providers who are disclosed to you when we collect your personal information (such as financing partners if you select this option during the checkout process). You may opt out of receiving communications from any such third party pursuant to that third party’s policies. We do not control any third parties or their policies.  
 
Government Officials / Law Enforcement. We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information:  (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, or (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, Enerfina or any other party. 
 
Professional Advisors. We may disclose Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors, and business advisors, in their capacity as advisors to Enerfina.  
 
Change in Ownership. In the event Enerfina is the subject of a change of control or in the event our Services changes ownership, in whole or in part, or in the event of a bankruptcy, receivership or a similar transaction, we may provide Personal Information to the subsequent owner(s). 
 
Other. We may disclose Personal Information with third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure). 
 
Use and Disclosure of Non-Personal Information.  
 
Enerfina may collect, use, disclose, transfer, and otherwise process de-identified and aggregated information that it receives or creates for any purposes in its sole discretion, in compliance with applicable laws. Enerfina is the sole and exclusive owner of such de-identified and aggregated information, including if Enerfina de-identifies Personal Information so that it no longer considered Personal Information under applicable laws.  
 
Children’s Information.  
 
The Services are not directed at children under 16 years of age. We do not knowingly collect, sell, use, or share Personal Information from children under 16. If we obtain actual knowledge that Personal Information has been provided by a child under the age of 16, we will promptly delete that information. If a parent or legal guardian learns that their child provided us with Personal Information without his or her consent, please contact us and we will make commercially reasonable attempts to delete such Personal Information. 
 
Data Security 
 
We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. If a breach of your Personal Information occurs, we will notify you of the breach if required under applicable law. 
 
You understand that no data transmission over the internet or device can be guaranteed to be 100% secure. While we strive to protect Personal Information, we do not guarantee the security of Personal Information and you provide Personal Information at your own risk.

We are active on social media, including Facebook, Instagram, X (formerly Twitter), TikTok, Reddit, and LinkedIn (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) any comments or content that you post on Social Media pages. Your use of Social Media is governed by the privacy policies and terms of the providers that own and operate those websites and not by this Policy. Access from Outside the United States 
 
If you choose to access the Services from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by the in other jurisdictions. 
 
Retention of Personal Information 
 
We will keep Personal Information for the period necessary to fulfil the purposes described in this Policy unless a longer retention period is permitted or required by law.

The Services may link to websites not controlled by us. We are not responsible for third parties’ privacy policies or practices. CALIFORNIA RESIDENTS’ PRIVACY RIGHTS 
 
This Section provides additional terms that apply to residents of California. In the event of conflict between this Section and the remainder of the Policy, this Section shall take precedence for California residents. In this Section only, any capitalized terms not defined in this Policy have the meanings set forth in the California Consumer Privacy Act of 2018, as amended, and including its implementing regulations (the “CCPA”). 
 
Collection, Use, Disclosure and Retention of Personal Information

Right to Non-Discrimination. You have the right to not receive discriminatory treatment for exercising any of your rights under the CCPA. Should you wish to exercise any of your rights as detailed above, we will not discriminate against you by offering you different services based solely upon your exercise of the above rights. Verifiable Consumer Request   
 
In order to verify your rights request, you must provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. This information may vary depending on the Personal Information we already have. We will only use Personal Information we collect during the verification process for the purpose of verifying your identity. We may use your account to respond to your request and/or verify your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.  
 
Authorized Agents  
 
You may only make a request to exercise your rights on your own behalf or via an authorized agent. If an authorized agent contacts us to exercise the above rights, we may be required to verify their identity as well as your identity.
